Details emerge on alleged after-prom choking in Newport

NEWPORT — Police records obtained by VTDigger reveal new details in the arrest of Michael Davis, the 18-year-old North Troy man accused of choking a girl at an after-prom graduation party on Sunday.

Vermont State Police troopers responded to North Country Hospital that day and interviewed the victim, a 16-year-old, who said she and Davis had been at a party on Buzznell Road in Newport Town that started Saturday night, according to an arrest affidavit.

She, Davis and others had been drinking, the document says.

The girl told troopers that in the early hours of Sunday morning, she found herself in a bathroom with Davis and another person after the 18-year-old had been trying to interact with her, the affidavit says.

Then Davis put her in a chokehold, she told troopers.

She said he stood behind her, wrapped his right arm around her throat and held that arm with his left, according to the affidavit. She said she had difficulty breathing and believed she lost consciousness, according to the document.

When she came to, Davis punched her several times in the arm and leg, she told troopers.

Later, Davis approached her while she was on a couch and tried apologizing, saying he didn’t know his own strength, the girl told troopers.

But then he tried forcing her into a kiss and started biting her neck, she said, according to the affidavit. She tried pushing him away and told him to leave her alone.

At the hospital on Sunday, troopers said the girl had a mark on the front of her neck consistent with a human bite mark.

Troopers found Davis later that day at his mother’s house in North Troy. He said the incident had been a playful pushing match and that his arm had been loose around the girl’s throat, according to the affidavit. He denied kissing her neck, troopers said, and said he had been extremely drunk.

But Davis later admitted he may have squeezed the girl’s throat too hard and that he hadn’t stopped when she said to, according to the affidavit. He also said he had tried to kiss the girl without consent and said he had bitten her because “he would bite women on their necks to attempt to arouse them,” according to the affidavit.

Davis faces one charge of aggravated assault and two charges of simple assault, according to court documents. He was held Sunday at Northern State Correctional Facility on $10,000 bail, and according to the Department of Corrections, he was released on Monday.
