Burlington man sentenced for selling heroin

A Burlington man was sentenced to three years of supervised release after he pleaded guilty to federal charges for dealing heroin.

Samuel Spivack, 32, was sentenced Monday, according to a news release from the office of the U.S. attorney for the District of Vermont. The judge ordered him to serve the first three months on home confinement. He also must complete 100 hours of community service and pay a $2,000 fine.

The release says Spivack sold heroin to support his own addiction, working with different suppliers from out of state. The Burlington Police Department worked with a confidential informant, who bought heroin from Spivack in controlled purchases.

Spivack could have faced a maximum of 20 years in prison, though advisory sentencing guidelines suggested a prison term of 27 to 35 months.

According to the news release, Judge William Sessions III weighed Spivack’s efforts in drug treatment, his addiction and his “lack of a serious criminal record” in deciding his sentence.
